Legal Disclaimer for Study in Switzerland

  1. No Guarantee of Placement

    • Study in Switzerland provides consulting and placement assistance but does not guarantee university admission, internships, or visa approvals. Final decisions rest solely with universities, employers, and Swiss authorities.

  2. Accuracy of Information

    • While we strive for accuracy, Study in Switzerland is not liable for errors in advice, third-party information (e.g., university requirements), or changes in Swiss laws/regulations.

  3. Client Responsibility

    • Students/clients must verify all requirements (academic, visa, etc.) with official sources. Study in Switzerland  is not responsible for rejections due to incomplete/incorrect client submissions.

  4. Limitation of Liability

    • Study in Switzerland ’s liability is limited to CHF 5,000 per claim (except for gross negligence/willful misconduct). We are not liable for indirect damages (e.g., travel costs, lost opportunities).

  5. Jurisdiction & Disputes

    • Any legal disputes shall be resolved exclusively in the Courts of Bern, Switzerland, under Swiss law.

  6. Third-Party Services

    • Study in Switzerland  may link to third parties (e.g., visa agencies) but does not endorse or assume liability for their services.

General Terms & Conditions

1. Scope & Applicability

These General Terms & Conditions (GTC) govern all services provided by Study in Switzerland ("the Agency") via its website (www.StudyinSwitzerland.org) or offline. By using our services, the Client (student, university, or employer) agrees to these terms.
 

2. Services Offered

The Agency specialises in:

  • Placement of students into Swiss universities (admissions consulting, application support).

  • Interim internship placements for students in Switzerland.

  • Additional services (e.g., visa guidance, accommodation assistance) as agreed separately.
     

3. Client Obligations

  • Provide accurate and complete information (academic records, CV, etc.).

  • Pay fees as per the agreed Terms of Payment (refer to the separate document).

  • Notify the Agency of any changes affecting placement (e.g., visa rejections).
     

4. Agency’s Responsibilities

  • Provide reasonable efforts to secure placements, but does not guarantee success.

  • Maintain confidentiality of client data (see Privacy Policy).

  • Comply with Swiss employment agency laws (Art. 319 ff. OR).
     

5. Fees & Payment

  • Fees are due as per the invoice (see separate Terms of Payment).

  • No refunds for services already rendered (partial refunds at the Agency’s discretion).

  • Late payments incur 5% interest p.a. (Art. 104 OR).
     

6. Refund Policy – No Guarantee of Placement

Study in Switzerland provides placement assistance but does not guarantee that a student will secure a university admission or internship. Final decisions depend on third parties (universities, employers, visa authorities, etc.).

If Study in Switzerland fails to provide a student with a confirmed study place or internship (due to STUDY IN SWITZERLAND’s own shortcomings, not student/third-party factors), the student is entitled to a 50% refund of the service fee paid.
 

No refunds will be issued if:

  • The student withdraws their application after submission.

  • The student is rejected by a university/employer for eligibility reasons (grades, language skills, etc.).

  • The student fails to submit the required documents on time.

  • Visa/immigration authorities deny the student’s permit.
     

Refund requests must be submitted in writing within 30 days of the rejection notice.


7. Liability & Disclaimers

  • The Agency is not liable for:

    • Rejection by universities/employers.

    • Visa denials or travel issues.

    • Client misrepresentation or misconduct.

  • Liability is capped at CHF 5,000 per claim (unless gross negligence).
     

8. Data Protection

  • Client data is processed per Swiss FADP and GDPR (if EU clients).

  • Data may be shared with universities/employers for placement purposes only.
     

9. Intellectual Property

  • The Agency owns all content (website, brochures).

  • Unauthorised use triggers legal action.
     

10. Dispute Resolution & Jurisdiction

  • Exclusive jurisdiction: Courts of Bern City, Switzerland.

  • Swiss law applies (excluding conflict-of-law rules).
     

11. Amendments

  • The Agency may update these GTC; clients will be notified via email/website.


12. Severability

If any clause is invalid, the rest remain enforceable.

From Study in Switzerland 

At Study in Switzerland, we prioritise transparency, legal compliance, and fair business practices. This document confirms our adherence to the following regulations:
 

1. Wix Compliance

  • Our website (www.StudyinSwitzerland.org) is hosted on Wix and follows its Terms of Service.

  • Our General Terms & Conditions (GTC), Privacy Policy, and Payment Terms are accessible in the website footer, as required by Wix’s guidelines.
     

2. Swiss Employment Agency Laws (Kanton Bern)

  • We operate under Swiss law, particularly the Code of Obligations (OR Art. 319 ff.) governing employment agencies.

  • Our services comply with Kanton Bern’s regulations for student placements (university admissions & internships).

  • Note: Our GTC will be reviewed by legal experts in Bern, Switzerland, to ensure full compliance.
     

3. Fair Treatment of Students (B2C) & Universities/Employers (B2B)

  • For Students (Consumers - B2C):

    • We follow Swiss consumer protection laws, ensuring no unfair clauses in our contracts.

    • Fees, refunds, and obligations are clearly stated in our GTC.

  • For Universities & Employers (B2B):

    • Agreements are based on mutual obligations and Swiss commercial law.
       

4. Dispute Resolution

  • Any legal disputes will be settled in the Courts of Bern City, Switzerland, as per our GTC.
     

5. Ongoing Legal Review

  • We are in the process of having our GTC reviewed by Swiss lawyers in Bern for full compliance. Updates (if any) will be communicated promptly.
